Digitalizacija in pravo: bolj kot se stvari spreminjajo, bolj so enake

Na podlagi zloglasnega dejstva digitalizacije naše dobe je prispevek osredotočen na verjetnost odnosov med pojmoma prava in vladanja v digitalni dobi, kot jih najdemo v znanstveni literaturi. Od skupno 3917 člankov, ki so bili v podatkovni zbirki Scopus opredeljeni kot relevantni za raziskave vladanja v digitalni dobi, je bilo 77 nadalje obravnavanih zaradi povezanosti med pravnimi pojmi in pojmi vladanja v digitalni dobi. Rezultati kažejo zelo skromno prisotnost prava v literaturi o vladanju v digitalni dobi. Na podlagi tega dokument potrjuje Collingridgevo dilemo nadzora in podaja odgovore glede meddisciplinarnega medsebojnega povezovanja prava in informacijske tehnologije, glede tega, kako se v zakonodaji obravnavajo digitalne razsežnosti in tehnologija, in glede tega, ali si slednja prizadeva za posodobitev ali zgolj odraža obstoječa načela javnega upravljanja. Vendar pa rezultati, ki temeljijo na pregledu literature, morda niso vedno usklajeni s praktičnimi učinki digitalizacije v družbi.
