The rapid development of the Internet and digital communication has increased the importance of internet hosting providers, which play a fundamental role in storing and making information available online. However, the activities of these providers raise significant legal questions concerning their tort liability for unlawful content published or stored by third parties. This study examines the legal framework governing the tort liability of internet hosting providers, focusing on the distinction between hosting providers, internet service providers, and content providers. It also explores the conditions under which hosting providers may be held liable for damages arising from illegal or harmful online content, as well as the circumstances in which they may benefit from an exemption from liability. The study adopts a legal and comparative approach by examining relevant legislation and judicial decisions in French, European, American, and Algerian law. Particular attention is given to the legal requirements governing the establishment of liability, including the provider’s knowledge of unlawful content and its response after becoming aware of such content. The study highlights the importance of balancing the protection of individuals’ rights and interests with the freedom of expression and the development of digital services. It also emphasizes the need to clarify the legal obligations of hosting providers and strengthen the effectiveness of the applicable legal framework, particularly in Algeria.
