The latter, characterized by their continuous and rapid evolution, have exerted a profound influence on the fundamental principles of contract law, from the negotiation phase through to the performance of the contract. This influence has driven the transition from the traditional concept of contract to the electronic and smart contract, giving rise to numerous challenges concerning the application of the general theory of contract within the digital environment. These challenges could only be overcome through the renewal of its foundational principles, in order to achieve contractual balance and ensure legal and contractual security and stability.
