Diskrecijska pravica kot inovacija državne politike v Indoneziji

Namen raziskave je ugotoviti, kako se diskrecijska pravica v Indoneziji izvaja kot oblika inovacije vladne politike. Pomen diskrecijske pravice za lokalne oblasti je zagotavljanje inovativnih politik za idealne storitve javne uprave. Ta študija uporablja normativne pravne raziskovalne metode z različnimi pristopi: zakonskimi, konceptualnimi, pristopi na podlagi primerov in primerjalnimi pristopi. V študiji sta bili uporabljeni deskriptivna in preskriptivna analitična metoda. Rezultati razprave kažejo, da so diskrecijske ureditve, ki se izvajajo kot oblika inovacijske vladne politike, koraki, ki jih je treba sprejeti v podporo inovativnim uradnikom kot prizadevanje za iskanje stičnih točk med inovacijami in pravom in ne za pasivno uresničevanje inovacij. Diskrecijska merila kot inovacije vladne politike pri njihovem izvajanju se presojajo na podlagi štirih vidikov: pristojnosti, omejitev, testiranja in sodnega nadzora. Idealni diskrecijski model pri oblikovanju inovacijskih politik za uresničevanje birokratske reforme mora temeljiti na glavnih vrednotah države blaginje. Poleg tega morajo diskrecijske politike slediti vrednotam nacionalne ideologije, imenovane pancasila, in sodelovanju med organi. Diskrecijske politike morajo upoštevati splošna načela dobrega upravljanja (AUPB). Zato so za izvajanje diskrecijskih inovacijskih politik pri izvajanju birokratske reforme potrebna dodatna načela, in sicer načelo motivacije, načelo poštenega ravnanja, načelo prepovedi zlorabe pooblastil, načelo pravičnosti, načelo svobode, načelo integritete, načelo dejanskih ciljev, načelo učinkovitosti in načelo sodelovanja.
