Posledice delovne zakonodaje in zunanje izvajanje v javnem sektorju

Povzetek

Delodajalci se vse bolj zatekajo k pogodbenemu prenosu določenih dejavnosti na zunanje izvajalce. Pravni status delavcev, ki so predhodno opravljali to delo pri delodajalcu, je večinoma odvisen od tega, ali je prišlo do prenosa podjetja v smislu Direktive 2001/23/ES. Glede na sodno prakso Sodišča Evropske unije je poleg izvajanja istih dejavnosti pogoj tudi prenos bistvenih sredstev dela ali prehod delavcev. Ker je prehod delavcev v tem primeru odvisen od dogovora med izvajalcem in ponudnikom storitev, so v tem smislu pogoji javnega naročanja zelo pomembni. V prispevku je obravnavano vprašanje uporabe ali neuporabe uvedbe prenosa podjetja v primerih zunanjega izvajanja v javnem sektorju ob upoštevanju slovenske in hrvaške zakonodaje in Direktive.
