Normativni model nadzora nad dejavnostmi občin na Poljskem

Občine so glavne enote lokalne samouprave na Poljskem. Ustava iz leta 1997 jim zagotavlja samoupravo in neodvisnost, tako v smislu njihovih javnih nalog kot nalog, ki jih naročijo osrednji organi. Samoupravljanje in neodvisnost občin nista absolutna. Dejavnosti občinske samouprave so pod nadzorom z vidika zakonitosti, nadzorni organi pa so vladni upravni organi in regionalne revizijske zbornice. Namen te študije je podrobno rekonstruirati poljski model ustavnega nadzora nad dejavnostmi občin in njegovo vrednotenje s teoretičnega teleološkega in funkcionalnega vidika. Na podlagi analize je bilo ugotovljeno, da je sprejeto merilo nadzora dovolj opredeljeno, da se prepreči preveč svobode vmešavanja v dejavnosti občin, omogoča ustrezno zaščito interesov celotne države in njenih državljanov. Tako poljski normativni model ustreza teoretičnim predpostavkam.
