This study explores the expanding role of artificial intelligence as a transformative driver within the Algerian banking system, emphasizing the tension between technological innovation and the imperatives of legal regulation. It analyzes how intelligent systems enhance banking efficiency through credit automation and improved customer service, while contributing to the strengthening of domestic financial governance and the promotion of financial inclusion across regions. Using a comparative analytical approach, the study highlights key legal challenges related to civil and criminal liability arising from algorithmic decision-making, as well as the risks of geographic discrimination affecting spatial equity in the distribution of financing. It concludes by underscoring the need to address legislative gaps in Algerian monetary and banking law (Law No. 23-09) through the establishment of regulatory frameworks that ensure algorithmic transparency and the protection of customer data, thereby achieving a balanced reconciliation between digital innovation and legal certainty.
