THE OBLIGATIONS ARISING FROM THE MANDATORY INSURANCE CONTRACT AGAINST NATURAL DISASTERS IN ALGERIAN LEGISLATION

Natural disasters are associated with sudden risks that affect humans and their lives. To confront these risks and mitigate their impact, the legislator has mandated insurance coverage for them.
Insurance against natural disaster risks aims to repair losses affecting properties, governed in all its forms by the indemnity principle. Legislators have mandated that all property owners, whether individuals or legal entities, insure built real estate properties used for residential or professional purposes against natural disaster risks, as well as insurance for industrial and commercial establishments.
Since the insurance contract for natural disaster risks is a bilateral contract, it establishes legal effects based on reciprocal obligations for both the insured and the insurer. Each party must fulfill its obligations to the other party.
