THE EVOLUTION OF CIVIL TRANSACTIONS LAW (CTL) IN SAUDI ARABIA: BALANCING SHARĪʿAH PRINCIPLES AND MODERN LEGAL TRENDS

Abstract

This paper investigates the evolution of civil transactions law in Saudi Arabia with a specific emphasis on the influence of Sharīʿah principles and their intersection with contemporary legal patterns. The recent enactment of the new Civil Transactions Law is a noteworthy achievement in the legal system of Saudi Arabia, as it signifies a shift from an adherence to uncodified principles of Islamic law to the establishment of a structured framework based on civil law. This study analyses the primary components of the recently enacted legislation and their ramifications on civil transactions, considering the balance between Sharīʿah principles and contemporary legal practices. The paper further examines the strengths and weaknesses associated with the implementation of the new legislation with provide some solutions.
