Ustavne dolžnosti in decizionizem v kontekstu izvajanja političnih funkcij organov ustavnega nadzora: sistemski in organizacijski vidiki

Namen te študije je preučiti vlogo ustavnega nadzora v okviru državnih zakonodajnih in izvršilnih funkcij ter vpliv organov ustavnega nadzora na politični razvoj, gospodarsko preobrazbo in socialno politiko. Študija preučuje vlogo in mesto ustavnega nadzora v državnopravnem mehanizmu, prednosti in slabosti specializiranega in nespecializiranega ustavnega nadzora, preventivnega ustavnega nadzora. Študija ugotavlja, da je model nespecializiranega centraliziranega ustavnega nadzora zelo obetaven in sposoben učinkovito uravnotežiti logiko decizionizma (diskrecije) in obseg ustavnih odgovornosti. Ta študija preučuje razmerje med ustavnim nadzorom in decizionizmom z vidika ruskega pravnega sistema. V praksi je ta študija zanimiva za predstavnike pravne stroke, ki se ukvarjajo s področjem varstva človekovih pravic, organizacije za človekove pravice in člane sodstva.
