Abstract

Artificial Intelligence (AI) has been evolved from being a helpful instrument to a creator which is that has led to questioning the existing structure of Intellectual Property Law and Branding works. The Trade Marks Act, 1999 is being drawn out in ways not contemplated by lawmakers in particular in designing logos and which determine the next large marketing drifts. The paper scrutinizes two critical queries about who is responsible for Artificial Intelligence crossing the lines of existing rights, and who actually owns a mark created by Artificial Intelligence? Considering at recent cases in India, along with what is happening in other countries, Indian Law needs to update on serious notes. The goal for helping for up keeping the standards of Indian trademark with the fast-moving digital global economy.
